Explaining UK Data Protection Act 2018 obligations (& implications) to Law Enforcement Competent Authorities & partners
I'm being asked what the issue is with Hyperscaler use by Policing. Its complicated, but here again I've tried to explain that its two-fold: 1 - The Cloud platforms in use (Microsoft and AWS) don't meet the key legal requirements required in the Data Protection Act (and really never shall) 2 - Even if they did, the mandatory processes for each and every transfer are so inefficient that they simply can't be lived with. Hyperscaler transfers create just about as much compliance documentation as the data they process. The problem isn't with the law however: its about bad technology choices. If you need to change the law to use your chosen Tech platform - as the Gov now seek to do in the DUAB - then really you should be questioning if you chose the right tech in the first place. (CLUE: You didn't) 🤷♂️
Why saying "Police use of Public Cloud is Illegal" is only mostly (and practically) true...
