Syam Soni secures acquittal in Death by Dangerous Driving Case
Syam Soni has achieved a significant acquittal for his client, who was charged with causing death by dangerous driving.
The case involved a tragic collision on a busy street in Manchester, where two vehicles, including that of the defendant, were recorded traveling at excessive speeds—sometimes exceeding 60 mph in 30 mph zones. The co-defendant collided with and tragically killed a cyclist, leading to both drivers being charged with causing death by dangerous driving.
The prosecution's case against Syam’s client was based on allegations that the two drivers were racing or driving competitively, which they argued made both parties responsible for the fatal collision. However, the co-defendant, who pleaded guilty to the charge, submitted a basis of plea asserting that the deceased had moved into his path and that there was no racing between the vehicles. This statement remained unchallenged by the prosecution at the time.
Syam Soni argued that his client was not racing or driving competitively and that the responsibility for the collision lay solely with the co-defendant. Furthermore, it was argued that even if legal causation were established, the actions of the deceased cyclist in moving into the co-defendant's path absolved Syam’s client of any liability for the incident.
The trial, which lasted five days at Manchester Crown Court, involved complex legal arguments, including issues of bad character, causation, and remoteness, as well as the instruction of multiple experts to challenge the prosecution’s case and assess the speeds of both vehicles.
Syam’s client, who had admitted guilt to a lesser charge of dangerous driving, was ultimately acquitted of causing death by dangerous driving.
