"From the Track to the Marketplace: The Case of Julien Alfred" From the moment Julien Alfred won Saint Lucia’s first Olympic Gold and Silver Medal in the Women’s 100m and 200m respectively, entrepreneurs and fans in Saint Lucia and across the world, started to ‘create’ merchandise and paraphernalia in her ‘likeness’ and ‘image’ to show support and/or make profit. What may seem innocent and 'entrepreneurial' can have significant implications under Intellectual Property Law and for the brand and identity of our track star. Social media was ablaze with Alfred inspired T-shirts, bags and other materials suggesting that she was in support of global movements and political campaigns, such as the Kamala Harris’ presidential campaign. In my latest Blog in IP ArchIPelago, I assessed the legal implications of these business practices as a means of attempting to explain the test for liability and possible implications from passing off to personality rights. I also made the call for statutory intervention in personality rights in Saint Lucia to protect our celebrities, while also advocating for Julien and other Caribbean athletes to utilise Intellectual Property Rights to protect their image and brand for economic advancement. COBALT Estonia Partner and Head of Competition Practice Group, Elo Tamm, contributed to EPL, offering insights into a recent Supreme Court ruling on important considerations for sports associations. The Court's decision highlights that national sports associations are monopolies since they have special right to organize national championships. As such, they are prohibited from abusing the dominant position. Associations must ensure that their decision-making processes are transparent and non-discriminatory, as any misuse of authority could constitute a breach of both Estonian and EU competition law. This ruling serves as a reminder that sports organizations need to carefully review their practices to avoid potential legal repercussions, including fines from the Competition Authority. As disputes within sports organizations become more common, this precedent underscores the importance of upholding fair and equitable governance in the sports industry.
