In November 2020, our team was tasked with securing Land Rights for work that had already been completed without easements in place at Chester Zoo. Despite encountering some challenges along the way, we were able to secure a deed of easement for a stretch of gas pipeline.
Our team worked diligently to obtain the full design and conveyancing plans, prepare the legal drawing, and instruct solicitors. We had to obtain consent from the Charity Commission as the landowner was a charity, which required persistent follow-up but was eventually obtained. Final land registry searches highlighted that the land was subject to a prescriptive easement, which had a potential impact on the apparatus. 🧾✔
The project highlighted the importance of securing land rights prior to providing a connection, something we regularly advise our clients on. It also demonstrated the necessity of remaining persistent in securing rights for connections that have already been authorised ahead of legals. Additionally, it served as a reminder that final searches should be lodged in good time as they may highlight additional issues prior to the completion of a file.
Determination and perseverance ensured we were able to navigate these challenges and secure the necessary land rights for our client.
