Bartlett Morgan is a Caribbean-based attorney-at-law and consultant who is currently the Managing Director of Chancery Advocates. He is a member of the International Association of Privacy Professionals (IAPP), the Information Systems Audit and Control Association (ISACA) and the International Network of Privacy Law Professionals (INPLP). He holds a certificate in Data Protection Officer Skills and has received training from the University of Oxford’s Said Business School on Cybersecurity Leadership. He has provided data protection and privacy support to clients in the Caribbean, the United States and South America. He has authored GDPR compliance guidance for Caribbean-based service providers and also made oral and written submissions to the Joint Select Committee of Parliament established to debate and report on the bill that eventually became the Barbados Data Protection Act, 2019-29. It was an absolute pleasure to participate (albeit virtually- alas, the power of technology 😁), on behalf of Bloomfield Digital Inc, in the Panel Discussion: Data Protection Across Borders: Managing Multi-jurisdictional Data Flows at the recently held Prioritizing Privacy Conference Beyond Registration in Jamaica hosted by Privacy & Legal Management Consultants Limited ("PLMC"). Just when you thought you had your #privacy audit processes in place for your organisations' web and app projects... ENTER WEB ASSEMBLY!!! Now I started my career over 30 years ago writing software in assembly language (yes back then we didn't have scripting languages or many of the high level languages we have today - we had to write our code in assembly), it was incredibly fast to execute but it was also incredibly complex to write and audit. Assembly language is a low level language, it is the stuff of computer science and not really something your average web developer will have the skills or knowledge to take on. But there are many software houses now creating custom web applications which are written in Web Assembly (especially for 3D environments). We literally move data manually from where it is stored to where we want it to be to do a specific thing (using hardware memory addresses, registers and other complex tech things that most people have never heard of). There is no tool currently that I am aware of which can be used to audit applications written in web assembly (no TrustArc, OneTrust etc. will not be able to do this for you) - so how do you meet your accountability obligations under #GDPR? 1. Software developers creating applications in Web Assembly *must* document their code and provide that documentation to you (so you can verify). 2. Organisations using web assembly apps must keep the documentation from 1 above with the rest of the accountability documentation so they have it to hand in the event of an audit or investigation. 3. Organisations *must* ensure they have the necessary contractual obligations on the developer/provider of the app to make it clear that if the code behaves differently to their documentation - they are liable for breaches of law which occur as a result. I just spent 2 days going through a web assembly app - my head hurts and I used to write software in assembly for a living (I am probably one of a handful [if that] of privacy professionals on the planet with experience of software development in assembly language - I may even be the only one) - so a regular compliance/privacy professional is likely to suffer cranial detonation if they try... but you can't just ignore it because it is difficult. Seven organisations with responsibility for security across five countries have published a brief document on how to securely deploy AI Systems. The joint authors are:the National Security Agency’s Artificial Intelligence Security Center (NSA AISC National Security Agency), Cybersecurity and Infrastructure Security Agency), the Federal Bureau of Investigation (FBI), the Australian Signals Directorate's @lAustralian Cyber Security Centre (ASD ACSC), the Canadian Centre for Cyber Security (CCCS), the New Zealand National Cyber Security Centre (NCSC-NZ), and the United Kingdom’s National Cyber Security Centre (NCSC-UK). Plainly, the purpose of the guidance is to encourage three main behaviors: 1️⃣Think Fort Knox for your algorithms, to prevent unauthorized access and ensure data privacy by prioritising confidentiality, integrity and availability. 2️⃣ Let's be real, ike any digital system, AI-focused ones also have vulnerabilities. Find and fix them to keep your systems strong and reliable. 3️⃣ Equip your AI deployment with appropriate security mechanisms to protect, deflect and respond to cyberattacks and other malicious activity. This way, your AI deployment can help you focus on what you does best and not fighting off bad guys.
