MSPA Accountability Program:

IAB Privacy, Inc. offers a voluntary Accountability Program as part of its Multi-State Privacy Agreement (MSPA) compliance framework. MSPA Signatories may participate in the Accountability Program to demonstrate how they actually comply with the requirements of the MSPA, and earn an “MSPA Certified” seal if they demonstrate compliance with the applicable requirements. The “MSPA Certified” seal provides a level of assurance to other participants in the MSPA compliance framework – as well as other compliance stakeholders, such as regulators – that the Signatory that earned the seal is in material compliance with the MSPA’s requirements.

Applicants to the Accountability Program must submit to a voluntary assessment conducted by an Authorized Asessor designated by IAB Privacy (and listed below) to demonstrate accountability. If IAB Privacy designates more than one Authorized Assessor, applicants may use the Authorized Assessor of their choice. MSPA framework requirements that will be evaluated during an applicant’s voluntary assessment include:

  • how end users are provided with transparency and choice mechanisms consistent with MSPA framework requirements;
  • how personal information processed through MSPA Covered Transactions is limited to Signatories and Certified Partners only; and
  • how an applicant processes personal information in connection with Covered Transactions consistent with the MSPA framework’s applicable use limitations;
  • how an applicant has implemented technology that processes GPP signals in a way that complies with MSPA framework requirements; and
  • the integrity of Global Privacy Platform (GPP) signals processed and shared through Covered Transactions;

What to expect from the assessment process:

After submitting an application, applicants must cooperate with the Authorized Assessor selected to complete the Questionnaire. An Authorized Assessor may, with approval from IAB Privacy, make changes to the form (but not the substance) of the questionnaire.
In evaluating a Questionnaire submission, the Authorized Assessor will follow assessment procedures approved by IAB Privacy, which will include procedures for interviewing, requesting additional materials, and evaluating applicant responses for MSPA compliance purposes.
Scope of MSPA Accountability Program:

The MSPA Accountability Program is currently available only to Downstream Participants. IAB Privacy may open the program to First Parties at a later date.
Authorized Assessors:

  • The Network Advertising Initiative (NAI).
  • *Only available to MSPA Signatories that are also NAI member companies.
  • Additional authorized Assessors will be available in the coming months.
Program fees:

There are no fees for NAI member companies who use the NAI as an assessmentpartner during the 2023 to 2024 assessment cycle. IAB Privacy anticipates publishing a fee schedule for any additional assessment partners added to the program in the future.
