A predatory claims culture harms consumers, employers and Britain. The price of litigation culture on the customer is significant and growing. From unfairly reduced settlements and damages, to additional costs like increased insurance premiums, the customer shouldn’t have to foot the bill.

Following the news that Mastercard has settled its Competition Act group claim for £200 million – leaving around £4 per claimant – our Executive Director, Seema Kennedy OBE, has shared her thoughts with The Law Society Gazette. Given that this sum will decrease further after legal costs, the outcome raises serious questions about who truly benefits from the years and taxpayer money dedicated to putting class actions through court: consumers, or lawyers and litigation funders? Yesterday, Fair Civil Justice hosted its quarterly meeting, bringing together British businesses and trade associations to discuss the growing trend of class actions and litigation funding in the UK, as well as current regulatory frameworks in the UK, EU and Australia. Key discussions highlighted that access to justice includes alternative dispute resolution (not just the courts), and the need for stronger safeguards in the litigation funding industry. As we look ahead to 2025 and the Civil Justice Council’s review of litigation funding, set for Summer 2025, we also encouraged everyone to submit their views to its consultation.
