Our Cayman office once again supported the annual Toys for Tots campaign. Staff brought in new toys and participated in the office raffle and festive jumper day to raise additional funds to purchase toys for the Toys for Tots drive. With it being the season of goodwill and giving we just wanted to highlight the good work Partner Nick Ward is doing for an extremely deserving Jersey charity. Nick is completing the One Million Step Challenge this month to raise £3,000 for The Grace Crocker Family Support Foundation. This charity was set up in memory of Grace Crocker to help other families from Jersey who need to spend time in the UK whilst their child receives medical treatment in a hospital. Having been doing around four hours of walking each day, Nick has reached the half way mark and is at 500,000 steps. He has until 31 December to hit the one million step mark. We are so are proud of Nick's efforts for such a worthwhile charity. Guernsey Managing Partner Gareth Bell and Professional Support Lawyer Jack Crisp authored the Guernsey response, while Partner Simon Hurry and Senior Associate Karen Stachura authored the Jersey response. The 2024 survey, which categorises the current effectiveness of unilateral option clauses around the world, provides an expanded update to the 2021 survey and covers 120 jurisdictions. It was a closely fought win for the Jersey College for Girls in the final of the inaugural Jersey Collas Crill Moot. Jess Dos Santos Hilario and Alexia Jennings were the ultimate winners in the dramatic final of the mock trial competition, which took place in the States' Chambers on the evening of Monday 9 December. We are grateful to the Bailiff Sir Timothy Le Cocq KC who - even on his birthday - was head judge, supported by Collas Crill's Damian James and Nuno Santos-Costa as jurats on the judging panel of the mock trial. Around 60 sixth form students from Hautlieu, De La Salle, Jersey College for Girls, Victoria College and Beaulieu took part in the competition, which launched in Jersey in September. Eight students from JCG, De La Salle College, Jersey and Beaulieu Convent School progressed through three rounds of the competition to take part in the final. Jonathan Barham, Collas Crill Partner, said: 'All the finalists performed brilliantly and handled some particularly tough questions from the Bailiff. I was impressed how they rose to the challenge and how eloquent they were in their responses. It was clear to everyone in the States' Chambers how seriously the students had taken the Moot, and how much preparation they had done for the final. My congratulations go to Jess and Alexia for being our first Jersey Moot winners and a huge well done to Ruby, Iona, Charlie, Hayden, Leila and Grace.' As a landlord what do you do when a tenant of your commercial premises becomes insolvent? All was revealed at our latest Guernsey Commercial Property Lunch, which was on the the topic of insolvent tenants. Our Real Estate team welcomed our colleagues Michael Adkins and James Tee to speak at the lunch. They explored insolvency processes in Guernsey from a landlord’s perspective, highlighting how landlords can protect themselves in challenging situations. Key takeaway? Preparation is key. The best way to protect yourself as a landlord is to prepare at the negotiations stages prior to the lease. Thoughtful planning can provide flexibility and protection if a tenant becomes insolvent. In a recent judgment in the Representation of Summit Services, the Royal Court of Jersey addressed a trustee's decision to separate and reallocate trust-owned assets which were held in four Jersey law discretionary family trusts. The case highlights the complex challenges faced by trustees when trying to manage intergenerational family wealth - particularly within a family comprising multiple generations and branches - highlighting the importance of a trustee’s structured decision-making process and the evolving judicial debate surrounding the role of protectors in trust administration.
