➡️ 𝗣𝗿𝗼𝗰𝗲𝗱𝘂𝗿𝗮𝗹 𝗿𝗶𝗴𝗵𝘁𝘀 𝗮𝗿𝗲 𝗳𝘂𝗻𝗱𝗮𝗺𝗲𝗻𝘁𝗮𝗹 𝘁𝗼 𝘁𝗵𝗲 𝗶𝗻𝘁𝗲𝗴𝗿𝗶𝘁𝘆 𝗮𝗻𝗱 𝗳𝗮𝗶𝗿𝗻𝗲𝘀𝘀 𝗼𝗳 𝗰𝗿𝗶𝗺𝗶𝗻𝗮𝗹 𝗷𝘂𝘀𝘁𝗶𝗰𝗲 𝘀𝘆𝘀𝘁𝗲𝗺𝘀, 𝗲𝗻𝘀𝘂𝗿𝗶𝗻𝗴 𝘁𝗵𝗮𝘁 𝘀𝘂𝘀𝗽𝗲𝗰𝘁𝘀 𝗮𝗻𝗱 𝗮𝗰𝗰𝘂𝘀𝗲𝗱 𝗮𝗿𝗲 𝘁𝗿𝗲𝗮𝘁𝗲𝗱 𝗷𝘂𝘀𝘁𝗹𝘆. 🏛 However, significant concerns have emerged about the inconsistent application of these rights across the EU. These inconsistencies not only endanger the fairness of criminal proceedings but also undermine public confidence in the justice system. Breaches during the pretrial phase — when suspects are most at risk of procedural violations — can lead to wrongful convictions, coerced confessions, and human rights abuses. 💡𝗙𝗨𝗟𝗟-𝗣𝗥𝗢𝗢𝗙, a new EU co-funded initiative, seeks to address these pressing challenges and promote further awareness and respect for procedural safeguards, in particular those enshrined in Directive 2012/13/EU (right to information), Directive 2013/48/EU (right to legal counsel), and Directive 2016/1919/EU (right to legal aid). 📝To achieve the aforementioned objectives, this IPS-led project will analyse the extent of breaches in procedural rights occurring in the early stages of proceedings, create a range of practical resources designed to assist legal professionals and law enforcement officers in their daily work, and deliver targeted cross-national and cross-professional workshops for practitioners. ➡ You can read all about this project here: https://loom.ly/E7hwN84 🇪🇺 FULL-PROOF is led by IPS_Innovative Prison Systems (Portugal), and is partnered by the Polish Platform for Homeland Security (Poland), Alma Mater Studiorum – Università di Bologna (Italy), Bulgarian Helsinki Committee (Bulgaria), Academia de Politie A. Implementing New Restraint Measures in Armenia's Criminal Justice System: The new Criminal Procedure Code of Armenia introduces house arrest and administrative control as alternative restraint measures. To ensure effective implementation, the Council of Europe is supporting criminal justice professionals through training and mindset shifts. On June 19-20, discussions were held on practical guides for applying these measures. The focus was on overcoming challenges, practical application, and fostering cooperation among criminal justice entities to promote the use of these alternative measures. https://lnkd.in/dhP2sNaq

Shifting the mindset works if we start putting learning experiences at the forefront of criminal justice: people un-learn and re-learn, making meaning of their experience. So lets promote correctional pedagogy as a key correctional competence for all the colleagues working in the ecosystem

The criminal justice process involves four pivotal stakeholders: 1. Law Enforcement and Judicial Officers (Police and Justice of the Peace) 2. Prosecution Services (Prosecutors) 3. Defense Counsel (Defense Attorneys) 4. Judiciary (Judges and Magistrates) The criminal justice process unfolds through three distinct phases: Phase 1: Administrative Phase From the filing of the First Information Report (FIR) to the submission of the Challan, this phase encompasses the investigative and pre-trial proceedings. Phase 2: Judicial Phase Commencing with the submission of the Challan and culminating in the final order of the court, this phase encompasses the trial proceedings, including evidentiary hearings, arguments, and judicial deliberations. Phase 3: Executory Phase Post-conviction, this phase involves the implementation and enforcement of the court's judgment, including sentencing, imprisonment, probation, or other corrective measures.
