The supercharged rhetoric of our presidential elections mirrors the supercharged powers of the modern presidency (and that's a bad thing). So much power is concentrated in executive branch agencies means that every change in presidential administration threatens a wholesale remaking of scads of policy questions. If we rigorously abide by the Constitution and insist that only Congress make law, there would be far less at stake in any given election. Thoughts from the Trenches: Vote. Vote early if you can, to make it easier for yourself and others. Election Day is one week away, and this election is too important to sit on the sidelines. I work regularly with people of all political persuasions. And I’ll tell them all the same thing: vote. Too many people died for that right for you to stay home. Too many people flee authoritarism and evil trying to obtain that right for you to stay home. As to who you should vote for, as an attorney, I’ll say only this: our election is a choice about whether the rule of law matters. One side made a career of enforcing the law, creating a climate of equal opportunity via accountability for rule-breaking. The other side made a career of breaking the law, creating a climate of chaos and distrust. Individuals and businesses crave the former, not the latter. We need to entrench voting rights. We need to replace the Electoral College with direct elections. We need to democratize the Senate. We need to eliminate the filibuster. We need to reform the Supreme Court. But our Constitution is exceedingly difficult to change. And in fact, our most significant constitutional reforms, the founding in the 1780s and the so-called second founding in the 1860s and early 1870s, occurred at moments when the constitutional order had at least partially broken down. A similar break in the constitutional order seems unlikely today, yet I think we must get constitutional reform into the public debate. We must get it on the public agenda. As I noted at the outset, our democracy stands at a crossroads.
