New Zealand's government plans to amend the Employment Relations Act to prevent workers earning over $180,000 annually from pursuing unjustified dismissal claims. The threshold, which will be annually adjusted, applies to base salary excluding benefits and incentives. The policy, part of the ACT-National coalition agreement, will be introduced through legislation in 2025. Other types of personal grievances remain available to affected employees. Has the new EU guidance sidelined labour rights under EUDR? Just a few words in the EU’s latest guidance, and suddenly, labour and related human rights requirements seem to vanish. Unbelievable? Consider this: chocolate produced on farms using child labour could now potentially be EUDR-compliant. Why? Because as long as the kids aren’t contributing to deforestation or biodiversity loss, it’s apparently acceptable. After all, it’s hard to argue that picking cocoa beans directly impacts forests. Joint statement: We join over 60 organisations calling on consultancies, auditors, certification bodies, and other service providers to immediately cease providing services in the Uyghur Region. Social audits and certification schemes fall short in adequately identifying and addressing state-imposed forced labour. The pervasive repression in the Uyghur Region makes it impossible to verify workplace interviews and conditions, and audits such as Volkswagen Group’s and Loening’s should not be deemed credible evidence that its supply chain is free of forced labour. We urge ALL companies, including Volkswagen to immediately end all operations and fully exit the Uyghur Region to prevent complicity in these crimes against humanity in line with the #UNGPs. Governments should not deem audits and certifications conducted in the Uyghur Region as credible evidence of human rights due diligence and adopt legislation with measures addressing state-imposed forced labour to #EndUyghurForcedLabour. EU finally bans products made with forced labour ⛏️ While certain EU ESG measures may find themselves in uncertain waters at the moment, Pauline Kuipers, Julia Barańska, and I also wish to point out that the Council adopted the '(Anti-)Forced Labour Regulation'. In brief, this Regulation: 🟢 Prohibits any product made using forced labour from being placed on the EU market or being exported from the EU market; 🟢 Enables national competent authorities to ban, withdraw and dispose of a product made using forced labour, which will apply in all other member states based on the principle of mutual recognition. 🟢 Empowers both the Commission (outside the EU) and national competent authorities (on their own territory) to launch investigations; 🟢 Requires the Commission to establish a database containing verifiable and regularly updated information about forced labour risks. The Regulation now awaits signing and will enter into force following its publication in the EU's Official Journal. Start of a new week and a new era! 😃 I went to work today with incredibly positive vibes from last week. As the EU Parliament approved two new business and human rights related legislations I could feel in the air how a new era for business and human rights is starting. Or more broadly you could say that it is a new era for responsible business conduct. An era in which human rights due diligence is made into legal requirements, and it is EU-wide. So what happened last week? First out was the EU Forced labor regulation which the EU Parliament adopted with a clear majority (555 votes for, 6 votes against, and 45 abstentions) on 23 April. With this law the EU is prohibiting the sale, import, and export of goods made using forced labor, and it includes the high risk of state-imposed forced labor in some contexts. Human rights due diligence is at the core of the forced labor regulation. In case of non-compliance companies can be fined and in case you are a manufacturer of banned products you will need to withdraw the products from the EU single market and donate, recycle or destroy them. Secondly, the EU Parliament adopted the game-changer directive the Corporate Sustainability Due Diligence directive (#CSDDD) after a roller-coaster process and delays earlier this year. The voting results were 374 votes for, 235 against and 19 abstentions. This directive will, if finally approved in May, make human rights and environmental due diligence mandatory, primarily for very large companies but it will also have a considerable trickle-down effect on small and medium-sized companies. The CSDDD also imposes the requirment on in-scope companies to both adopt and implement Paris Agreement-aligned climate mitigation plans aligned. And guess what? Worldfavor can already help companies to navigate to identify forced labor risks in value chains with the help of detailed questions, and we recently released a CSDDD-aligned solution for companies that don’t want to wait until 2027 to start working on the CSDDD. ⚠️ EU's Ban on Products Made with Forced Labour is set to become law ⚠️ Today (November 19), the Council of the EU adopted regulation banning products from the EU market that benefitted in part or in full from the use of forced labour. This means that the Forced Labour Regulation #FLR now just needs to be signed and published in the Official Journal of the EU before coming into force.
