Here’s a simple, step-by-step guide to help you through it. ☑️Step 1: Closing the Sale of Your Relinquished Property The 1031 exchange process begins when you sell your existing investment property, known as the relinquished property. This is an important step that sets the stage for the entire exchange. 1. Enter Into a Sales Contract: Once you've decided to sell, enter into a sales contract with a buyer. 2. Engage a Qualified Intermediary (QI): Before closing, hire a QI. The QI will hold the sale proceeds to ensure you never take constructive receipt of the funds, which is a critical requirement for a valid 1031 exchange. 2. Close the Sale: Complete the closing of the sale. The QI will take possession of the sale proceeds. ☑️Step 2: Identifying Replacement Property After closing the sale, you have a limited time to identify a replacement property. 1. 45-Day Identification Period: From the date of the sale closing, you have 45 days to identify potential replacement properties. You can identify up to three properties without any limitations or more properties if they meet certain value criteria. 2. Submit Identification to QI: Provide your QI with a written list of the identified properties within the 45-day period. The QI will document this information to ensure compliance. ☑️Step 3: Acquiring the Replacement Property Once you've identified the replacement property, the next step is to purchase it. 1.180-Day Exchange Period: From the date of the sale closing, you have 180 days to complete the purchase of one or more of the identified replacement properties. 2. Enter Into a Purchase Agreement: Negotiate and enter into a purchase agreement for the replacement property. 3. Coordinate with the QI: The QI will facilitate the transfer of funds from the sale of the relinquished property to the purchase of the replacement property. 4. Close the Purchase: Complete the closing of the replacement property within the 180-day period. Understanding these steps and timelines will help ensure a smooth 1031 exchange process.
