  • Land access v private property rights The recent row between Pippa Middleton, James Matthews, and the Kintbury village community over access to a footpath on their £15 million estate has ignited a debate on the complexities of land access and private property rights. This case is a vital reminder for landowners to proactively safeguard their assets while balancing public interests. Decisions in this dispute could set new precedents for land access in rural England. When longstanding paths meet private ownership, the legalities aren't always straightforward. Amy Cowdell and Esme Barker from Shakespeare Martineau offer their expertise. • A new report from the Law Commission of England and Wales calls for reform of financial arrangements on divorce, addressing criticisms like unpredictability, inefficiency, and lack of clarity in the current system. Proposals include four models - from codifying current case law to implementing strict asset division rules. While it has been broadly welcomed by family lawyers, experts caution against reforms that sacrifice flexibility. As Katherine Marshall of Shakespeare Martineau notes, 'No two cases are ever the same... changes must not come at the expense of fairness.' Others, including Jo Edwards, chair of Resolution’s Family Law Reform Group say the proposals still fail to address the rights of unmarried cohabiting couples. • Tax campaigner Dan Neidle has accused Ashley Hurst, head of client strategy at Osborne Clarke, of 'shocking threats' during a tribunal brought by the Solicitors Regulation Authority (SRA). The dispute centres around an email in which Hurst allegedly sought to block Neidle from exposing details about former chancellor Nadhim Zahawi’s tax affairs and an HMRC investigation that later led to Zahawi’s dismissal as Conservative Party chairman. This case is the first-ever SLAPP (Strategic Lawsuit Against Public Participation) brought before the tribunal. Dan Neidle, who published the email in 2022 citing public interest, argued: 'If I had not been able to publish, Mr Zahawi would still be in politics and might even be Prime Minister.' Hurst denies the accusations, maintaining he acted within legal and regulatory norms. • LGT Wealth Management has become the first company in Europe to adopt pass-through voting, a system that gives fund investors a direct say in the proxy voting process. Already pioneered in the US by firms like BlackRock, pass-through voting is gaining momentum as an alternative to the traditional, centralised approach to proxy voting. It allows investors to influence key decisions in the companies they own or invest in. It addresses growing calls for more shareholder engagement and alignment with investor values — particularly on issues like sustainability. This move by LGT Wealth Management reflects a broader industry shift, as regulatory pressure in the UK encourages trustees and wealth managers to take greater ownership of stewardship practices rather than delegating decisions to large asset managers.
