The PNLA is the association for professionals who specialise in dealing with disputes with non-medical professionals. The dispute starts with the involved parties. The claimant is the individual or business who sought help. The defendant is the professional adviser who may be funded by professional indemnity insurers. As more people become involved in the dispute process, the parties concerned instruct lawyers. Expert witnesses are often required to review the service of the professional and assess breach of duty. Litigation funders become involved when parties need help to finance the legal costs and expenses. Mediators or adjudicators may be appointed, with the agreement of all parties, to try and resolve the dispute by Alternative Dispute Resolution (ADR) instead of going to Court. More people will become involved if legal proceedings are commenced. The Court will be responsible for managing the timetable and procedure. A Judge will be asked to decide which party is successful in the outcome of the dispute. Usually, the losing party has to pay the legal costs. Assessing the amount may need the assistance of Costs lawyers, or law costs draftsmen. The PNLA offers a register of our members to help you find the right lawyer with experience in the type of dispute concerned, in the geographical region that is most convenient to you. It may be that you will need to go outside your region to find the appropriate lawyer to assist you. Our PNLA register of ‘specialists’ supports this process should a wider team be needed. There are hundreds of thousands of disputes every year collectively making these disputes a considerable influence in society. On 11 November 2024, Bates Wells was pleased to host an event to celebrate the 20th anniversary of the PNLA - The Professional Negligence Lawyers Association’s formation. In the keynote address, Lord Briggs championed voluntary adjudication and gave qualified support to the use of fixed costs and one way costs-shifting to promote access to justice. Alexander Barry, Claims Director at Collegiate, shares his insights with Insurance Post reflecting on the challenges and developments in the claims and legal sector. He highlighted his biggest disappointment as the difficulty in addressing predatory Claims Management Companies (CMCs) that exploit vulnerable individuals in the financial advice sector. These firms often mislead clients and take a significant share of any compensation. On a positive note, Alex welcomed the FCA’s consultation on charging CMCs fees for complaints lodged with the Financial Ombudsman Service (FOS). He sees this as a step towards introducing accountability and discouraging misuse of the service. Looking ahead to 2025, Alex noted that the sector faces significant regulatory changes from bodies like the FCA and SRA. These developments could influence how insurers and advisors respond to mass claims and compliance challenges. As a vision for the future, Alex expressed his hope for the creation of a unified professional body for financial advisors, which would foster collaboration and enable better responses to industry challenges. A nice result on Friday, summary judgment for £2.4m plus interest for a client following an investment fraud. An interesting case where the Defendant, a former solicitor, enticed our client to invest into a financial scheme. The Defendant gave a personal guarantee ("PG") to our client to ease concerns of making the investment. The investment went south and so did the PG. The Defendant sought to argue the PG the gave was a sham. The Defendant alleged the client was in on the PG being a sham to help the Defendant in relation to other creditors. The options to the client were to bring a claim on the underlying fraud or look to pursue the claim on the PG. We did the latter. Despite the usual arguments by a defendant of this nature saying the issues of the case needing a full trial to assess all the evidence, this case showed how the Courts are wising up to defendants trying to use their confessions of dishonesty to defend a claim i.e. the Defendant here saying believe me, I lied about the genuine nature of the PG. No need for a long drawn out case, summary judgment obtained and now onto enforcement. Great work by Kirthi Kalyan on the case with the support of Carl Garvie and counsel Paul Burton.

The Civil Justice Council has published its second final report on the subject of pre action protocols. The CJC recommends various changes which increase the obligation to try to resolve cases before resorting to the Courts.
