A Deed of Postponement is required when a Help to Buy: Equity Loan customer remortgages. It is the legal agreement between the first charge and second charge mortgage lenders, with the equity loan being the second charge. When preparing a customer’s Deed of Postponement , please can you check that the following details are included correctly: • name of the customer’s first charge lender (eg bank/building society), and our full name shown as ‘Homes and Communities Agency’ on the cover page • date that the equity loan was originally taken out • full name(s) of the customer(s) • property address and postcode • title number(s) of the property • sealing block with the name of the first charge lender and our full name shown as ‘Homes and Communities Agency’ For further details, please refer to our conveyancing pack.
