What Needs to be Reported: • Suspected Sanctions Violations: If you reasonably suspect that someone is violating sanctions (e.g., dealing with a sanctioned person). • Holdings of Sanctioned Persons' Assets: If you hold funds or economic resources belonging to a sanctioned person. (This applies to both businesses and individuals under specific regimes). How to Report: • Reporting Authority: The specific authority will vary depending on your location. In the UK, it's the Office of Financial Sanctions Implementation (OFSI) https://buff.ly/2LoMfrK. • Reporting Method: There are usually online reporting forms or phone numbers provided by the relevant authority. Additional Points: • Reporting requirements can be complex and vary depending on the specific sanctions regime. • Reports should be made "as soon as practicable." • Failing to report can be a criminal offense. Further Resources: • UK Government Guidance on Sanctions Reporting: https://buff.ly/3x4JDf3 • OFSI Blog on Reporting Sanctions Evasions: https://buff.ly/2LoMfrK please list sanctions reporting in the usa USA In the USA, sanctions reporting falls under the purview of the Office of Foreign Assets Control (OFAC) within the Department of Treasury. Here's a breakdown of sanctions reporting in the US: Who Needs to Report: • Financial Institutions: Banks, money service businesses, etc. They have a broad obligation to report on transactions involving sanctioned entities or countries. • U.S. Persons: Any individual or entity subject to US jurisdiction. This can include reporting blocked property (assets of sanctioned persons) or rejected transactions due to sanctions concerns. What Needs to be Reported: • Blocked Property: U.S. persons must report holdings of blocked property exceeding a certain threshold (usually $5,000) annually by September 30th. • Rejected Transactions: If a U.S. person rejects a transaction due to potential sanctions violations, they must report it to OFAC within 10 business days. • Suspicious Activity: Similar to the UK, there's a duty to report suspected violations of sanctions regulations. How to Report: • OFAC Reporting System (ORS): This is an electronic platform offered by OFAC for submitting reports. While currently voluntary, OFAC encourages its use. • Email: Reports can also be submitted via email to a specific OFAC address. • Paper Forms: Optional standardized paper forms are available for specific reports.
