ENS works to statelessness in Europe and to make ensure that those living in Europe without a nationality are protected under international law.

On #InternationalMigrantsDay, we highlight the necessity of identifying and addressing statelessness. Across Europe, stateless refugees struggle to access the protection they need. Only a handful of European States have legal and policy frameworks to identify and determine statelessness and to offer recognised stateless people the protection they are due under international law. This is why we are working with organisations across Europe to develop country-specific toolkits to support frontline asylum practitioners, NGOs, lawyers and border guards to identify when somebody might be stateless, and act accordingly. Half of #EU countries have missed their first deadline to submit their national implementation plans under the EU Pact on Migration and Asylum: https://lnkd.in/eMcAAVNb For the first time, the Pact included provisions on addressing statelessness. When the new EU Pact on Migration and Asylum was first presented in September 2020, statelessness was not mentioned. ENS has engaged extensively with the European Parliament, Council, and Commission to address this, and we welcome that several of our calls to address statelessness have now been heard and incorporated. Our new briefing provides recommendations to The European Commission, Member States, EU agencies, the European Parliament and Eurostat on how to implement the new statelessness provisions and ensure that stateless people’s rights are respected in EU asylum systems. ENS recommends that: 🔸 The European Commission engages with Member States, monitors how statelessness provisions are implemented and provides resources, and develops practical tools to identify and determine statelessness. 🔹 Member States adjust their national frameworks and policies, and upskill officials, to ensure that they can identify statelessness and uphold the rights of stateless people under international law. 🔸 EU Agencies (European Union Agency for Asylum – EUAA, FRA, Frontex, EU-Lisa) mainstream their legal requirement to identify and record indications of statelessness and ensure that mechanisms are in place to uphold the specific rights of stateless persons under international law. 🔹 Eurostat ensures that data collection mechanisms are equipped to identify and record indications of statelessness 🔸 The European Parliament monitors and provides oversight of implementation of the statelessness provisions and protection of the fundamental rights of stateless persons 🔹 UNHCR, the UN Refugee Agency and civil society actors incorporate recommendations on statelessness into relevant publications and advocacy interventions at regional and national levels, and ensure their teams are equipped to support stateless individuals and those with undetermined nationality to access their rights For our full set of recommendations, read our briefing: https://lnkd.in/eWeACNZ8 #Statelessness #HumanRights #EU #Asylum #Refugees #Migration #UniteToEndStatelessness
