  • ‘Parental help to buy’ concerns for lenders? We have a simple solution. Financial support from family members of young people saving for a deposit to buy their first home continues to rise – last year the figure totalled over £8 billion! As this trend is becoming increasingly common, our Insolvency Act covers have evolved to protect lenders when a parent or family member provides all or part of a buyer’s deposit, and is subsequently declared bankrupt. We offer two different policy options that protect the lender’s security in this scenario, where a subsequent Insolvency Act claim against the property, by the appointed Trustee in Bankruptcy, results in a shortfall in the outstanding debt under the mortgage. Our ‘parental help to buy’ policy can be used where some or all of the deposit is provided by parents or step-parents, with premiums starting from just £50 for a policy limit up to £100,000. We also have a non-parental option available where the deposit is gifted by other family members or godparents – policies start from £74. In each case, cover is available for both established and new build residential properties.   • Where a breach of planning conditions has existed for at least ten years, our Claims team will aim to prove that it is immune from enforcement action by the local authority. But as this case study shows, even where this is the case, resolving the claim effectively can be a slower and more costly process than you might expect.
