SFC’s continuous efforts to ensure asset managers’ compliance with regulations The Securities and Futures Commission (SFC) has recently published a circular highlighting deficiencies and substandard conduct in the management of private funds and discretionary accounts. Key issues highlighted include lack of integrity and of asset managers or their senior management, and ineffective supervision by the senior management. The SFC emphasizes the importance of addressing conflicts of interest, risk management, and accurate investor information. Also, asset managers must report any material breaches immediately. Suspect arrested in SG to face securities fraud charge in HK The Securities and Futures Commission (SFC) has intensified efforts to tackle ramp-and-dump cases in recent years, collaborating with local and overseas authorities. From 2023 to 2024, nearly 30 individuals were prosecuted for for ramp-and-dump market manipulation. Recently, a ramp-and-dump suspect was arrested by the Singapore Police Force and subsequently surrendered to Hong Kong after the SFC sought assistance from overseas authorities in naming the suspect on the INTERPOL Red Notice and surrendering the individual wanted for prosecution under the Securities and Futures Ordinance (Cap 571), marking a significant milestone. The SFC's commitment to cracking down on market misconduct is evident.
