Commerce Commission’s 2024-25 priorities: key takeaways for New Zealand businesses https://lnkd.in/gpPTJffu The Commerce Commission has released its 2024-25 priorities for compliance and enforcement, signalling various areas of heightened scrutiny that consumer-facing businesses should consider carefully. The priorities highlight that while the Commission’s role is expected to change in some respects (including an upcoming transfer of consumer credit oversight to the FMA) it remains firmly focused on its core consumer protection remit. For New Zealand businesses, these priorities underscore the need to revisit internal compliance frameworks, particularly marketing and consumer interaction practices, to ensure alignment with evolving regulatory expectations. Bell Gully’s competition practice continues to set the standard with a top-tier ranking in the Global Competition Review's GCR 100 2025. Global Competition Review's GCR 100 – a guide to the world's top competition law practices – has recognised Bell Gully as an elite practice (its highest ranking in New Zealand) for the past 20 years. We would also like to congratulate Penny Pasley who has been promoted to Special Counsel in Bell Gully’s competition practice, effective 1 January 2025. This is a fantastic recognition of her broad experience, involvement in several high-profile competition and corporate matters, as well as her commitment to supporting the development of junior members in the team. Are there limits on a liquidator’s power to request information from outside NZ? https://lnkd.in/gyMNpiSs When investigating the affairs of a company, a liquidator may exercise the statutory power to require information and documents from a director who lives overseas. But what about overseas shareholders, creditors and others? Last year we published an article following the High Court’s decision in Grant v Arena Alceon NZ Credit Partners LLC. The case was subsequently overturned on appeal, and last week the Supreme Court refused leave to appeal the decision.
