  • Legislation introducing changes to Foreign Resident Capital Gains Withholding (FRCGW) was passed by the Federal Parliament last week and will take effect for property contracts signed on or after 1 January 2025. FRCGW helps ensure tax liabilities owed by non-residents selling Australian property are collected. While Australian residents and citizens are exempt from paying this withholding, they must provide a clearance certificate from the ATO to avoid funds being withheld from their property sale. Here’s what’s changing: ➡️ The current $750,000 property value threshold will be removed, meaning the rules will apply to all property sales. ➡️ The withholding rate will rise from 12.5% to 15%. Under the new rules, all Australian residents selling property must obtain an ATO clearance certificate and provide it by settlement. If this isn’t done, 15% of the sale price will be withheld by the purchaser and paid to the ATO. Refunds will only be processed after the vendor’s income tax return is lodged. Are you selling property in 2025? Here’s what you need to do: ✔️ Clearance certificates are valid for 12 months, so you don’t need to wait until a contract is signed. ✔️ While most certificates are issued within days, delays can occur if your tax affairs aren’t up to date.   • According to REIWA, the median time to sell a house in Perth rose to 13 days in November, up from the nine-day median for most of 2024. While homes take slightly longer to sell, this remains a swift turnaround compared to pre-COVID levels, where the median was over 40 days. REIWA CEO Cath Hart attributes the change to a rise in new property listings, giving buyers more options and time to decide. The suburb continues to shine as a thriving and affordable option for buyers seeking a vibrant lifestyle in WA’s South-West. Over the past year, Bunbury has seen a 24.2% increase in its median house sale price, making it the fastest-growing regional centre in WA.
