With all the regulatory changes occurring at the moment, including AUSTRAC’s recently published exposure draft AML/CTF Rules, it’s worth remembering that one of the best ways to ensure compliance is by having the right people involved. As AUSTRAC states in its Consultation Paper: ✅ “AUSTRAC’s operational experience has found that a reporting entity’s effective identification, mitigation and management of ML/TF risk relies heavily on the individual fulfilling the AML/CTF compliance officer role." ✅ "…it is important to note that competence, character, diligence, honesty, integrity and judgement must relate to the duties of the AML/CTF compliance officer.” 👋 Reach out if you have any questions or want any assistance with understanding and meeting your obligations. How good is your training? ASIC's latest report on its insights about the reportable situations regime - Report 800 - highlights how important it is that you have the right training in place. Amongst the insights from ASIC are: 🔎 60% of reports specified that staff error or negligence was the root cause; 🔎 48% of breaches were identified by staff; and 🔎 "false or misleading statements” continues to be the leading category for reports. In the report, ASIC indicated that it expects the percentage of breaches reported by staff and other internal processes to be higher than it is.
