Even though anaesthesia is the second largest medical specialty (after General Practice) it has always perplexed me why professional negligence claims involving anaesthetists are so rare. Perhaps this reflects the extraordinary standard to which every anaesthetic is provided exists in Australia ?
As a leader in medical liability reporting in Australia with a focus on anaesthetics, Index Medicolegal has taken a particular interest in the recent appeal outcome in Fuller v Australian Capital Territory [2024] ACTCA 19. This reported decision delves deeply into the complexities of anaesthetic standards, especially when complications arise mid-procedure. In this case, a spinal needle incident during an obstetric epidural brought forward critical questions about the relationship between degrees of precautionary burden and the seriousness of potential harm in establishing breach, with the Supreme Court on appeal noting in particular “the nuance of the [medicolegal] opinions” submitted at trial. While this case pivoted on specific events in a maternity-anaesthetics setting, the Court’s interpretation of “actionable negligence” recognises some interesting considerations for how degrees of procedural diligence relate to practice guidelines and the duty of care across disciplines.
