Feeling a little like Santa today as I made my way around the city delivering some early Christmas cheer to Jacqui Eager and Kirsten Weber. 🎄 Their delivery? A pair of snazzy Index Medicolegal branded sneakers—just in time to step into the holiday season in style. 👟 While I didn’t think to wear a Santa hat this time, there’s always next year! We’ll be giving away more of these at conferences in 2025, so be sure to keep an eye out for my team and I. Wishing everyone a happy and safe holiday season!

  • 🌱 Chronic pain and psychological conditions are often deeply interconnected, and this complex relationship can significantly impact both an individual’s mental health and their recovery. In a medicolegal context, overlooking these links when assessing diagnosis, causation, and treatment can affect client outcomes. ⚠️ Non-organic factors—such as depression, anxiety, and environmental or cultural influences—can intensify the perception of pain and suffering. Over 60% of patients with chronic pain report symptoms of depression, with up to 40% meeting criteria for major depression. This bidirectional relationship can profoundly impact clients' work, social roles, and overall recovery. 🩺 For complex pain conditions like CRPS, fibromyalgia, or central sensitisation, consulting with a specialist in pain medicine is crucial for accurate assessment. Collaborating with both a psychiatrist and a pain medicine expert ensures a comprehensive understanding and a fair outcome. 📞 Reach out to us to learn more about how to navigate the complex interplay of pain and psychological factors in medicolegal cases. enquiries@indexmedicolegal.com 1300 668 446 #CRPS #Medicolegal #Chronicpain #Psychiatry #indexmedicolegal

  • Even though anaesthesia is the second largest medical specialty (after General Practice) it has always perplexed me why professional negligence claims involving anaesthetists are so rare. Perhaps this reflects the extraordinary standard to which every anaesthetic is provided exists in Australia ?

As a leader in medical liability reporting in Australia with a focus on anaesthetics, Index Medicolegal has taken a particular interest in the recent appeal outcome in Fuller v Australian Capital Territory [2024] ACTCA 19.   This reported decision delves deeply into the complexities of anaesthetic standards, especially when complications arise mid-procedure.   In this case, a spinal needle incident during an obstetric epidural brought forward critical questions about the relationship between degrees of precautionary burden and the seriousness of potential harm in establishing breach, with the Supreme Court on appeal noting in particular “the nuance of the [medicolegal] opinions” submitted at trial.   While this case pivoted on specific events in a maternity-anaesthetics setting, the Court’s interpretation of “actionable negligence” recognises some interesting considerations for how degrees of procedural diligence relate to practice guidelines and the duty of care across disciplines. • The 2024 Expert Witness Conference is underway in London with a fascinating critique by the Chair of the UK Bar Council on the problem of experts not fulfilling the overarching duty to assist Courts and being seen as partisan. Index Medicolegals experts are attending this conference as a part of our effort to equip our experts to provide independent opinions for use by courts in England and Wales.#expertevidence#courtworthy#trainingandeducation.
