  • Last Friday, our Brisbane team celebrated the end of 2024 at our annual HPL Christmas Party. Here are just a few snippets of our evening.   • WORKER’S COMPENSATION WEEKLY PAYMENTS NSW AND THE “260 WEEK RULE” In NSW, injured workers who have been receiving weekly benefits for an aggregate period of 260 weeks (5 years) will see those benefits cease. Notably, this also impacts your entitlement to medical expenses. There are exceptions to this rule though. Seek advice immediately, from a lawyer experienced in NSW worker’s compensation.   • A genuine redundancy occurs when an employee’s employment is terminated at the employer’s initiative because the employer no longer requires that job to be done by anyone. The exception to this is where the employment ends due to the “ordinary and customary turnover of labour”. A redundancy can still be a genuine redundancy even if, for example, some or all duties performed by the employee still need to be performed but are instead “reallocated” or “absorbed” by one or more other employees or contractors as part of a restructure.   • An accountancy firm and a principal advisor from the firm have been fined almost $70,000 for contraventions of the Fair Work Act. The firm were the accountants for a number of entities being investigated by the Fair Work Ombudsman for failure to keep employee records, in contravention of the Act. The firm and its principal advisor were fined for failure to comply with written “notices to produce” served upon them by the FWO, which was found to have constituted “involvement in a contravention”.   • The vast majority of Australian workers have a superannuation account. The primary purpose is to save for life after retirement but on top of that, most super funds also provide insurance options for the worker. These vitally important disability insurance products can include TPD, income protection and death benefits.   • Employers know that there are risks involved when they commence a workplace investigation and disciplinary process. They know that if they don’t do it right, they open themselves to the risk of ending up in a Court or Tribunal which may overturn their decision, award compensation and have serious implications for their reputation.
