Happy New Year! Back in December 2024, the court in Allen Waiyaki Gichuhi Sc & 2 Others Vs Data Protection Commissioner & 2 Others made a determination on the need to seek leave for judicial review proceedings. John Willys and Robinson Maina provides this analysis in our December 2024 Newsletter. The main argument presented is that ideally, an Applicant cannot possibly seek judicial review reliefs without first seeking leave to file the substantive motion for judicial review. Happy Reading!!

The question of jurisdiction of the Magistrates’ courts in claims for adverse possession is one that, up until recently, remained a hot topic, open for discussion. While the question of jurisdiction is an expression of the law, a sampling of case law from the various courts demonstrates that no accord subsisted on the question whether Magistrates’ courts are clothed with the requisite jurisdiction to hear claims for adverse possession. 🏡 Property Tips Thursday: Overview of Kenya’s Land Title Regimes 📜 This week, our Senior Associate, Ian Odongoh, unpacks the evolution of land title regimes in Kenya: 📖 Government Lands Act (GLA) – Issued by the Crown and was common with colonial settler lands. 📖 Registered Titles Act (RTA) – Introduced in 1920, primarily to aid in issuance of titles. 📖 Registered Land Act (RLA) – Enacted in 1963 introducing Title Deeds and Certificate of Lease as the forms of Title, with registries being in every Kenyan district. 📖 Land Registration Act (LRA) – Enacted in 2012, repealing all previous regimes (GLA, RTA, and RLA) to unify land registration and title systems. 🔑 The update below presents a detailed breakdown of these Title Regimes in Kenya.
