New Proposition 65 requirements are effective January 1, 2025, with a three year period for implementation. What does this mean for companies? Read more from one of our Senior Regulatory Experts, Craig Howard.
California’s OEHHA has adopted a proposed rule to more closely align short-form warning labels with long-form warnings under Proposition 65. Effective January 1, 2025 (with a 3 year implementation period), companies will need to specifically name the chemical triggering the exposure warning, along with its associated cancer and/or reproductive harm. (Yes, your goods manufactured before then can still use the old label format.) Here’s why this is a big deal: -It’s going to get much easier for bounty hunters to identify non-compliant labels -Companies that purchased generic labels instead of doing supply chain due diligence won’t be able to do that anymore -Proposition 65 compliance is going to get more costly and time-consuming for companies that haven’t invested in their compliance program I’ve published a short blog that covers the must-knows about this new rule.
