𝐒𝐡𝐨𝐮𝐥𝐝 𝐭𝐡𝐞 𝐞𝐧𝐫𝐨𝐥𝐦𝐞𝐧𝐭 𝐟𝐞𝐞 𝐟𝐨𝐫 𝐥𝐚𝐰𝐲𝐞𝐫𝐬 𝐛𝐞 𝐫𝐞𝐯𝐢𝐬𝐞𝐝 𝐭𝐨 𝐫𝐞𝐟𝐥𝐞𝐜𝐭 𝐢𝐧𝐟𝐥𝐚𝐭𝐢𝐨𝐧? 𝐓𝐡𝐞 𝐂𝐨𝐧𝐭𝐞𝐱𝐭 The Bar Council of India (BCI) has moved the Supreme Court, requesting an amendment to the Advocates Act, 1961, seeking a revision of enrolment fees for lawyers. 𝐖𝐡𝐚𝐭’𝐬 𝐭𝐡𝐞 𝐂𝐮𝐫𝐫𝐞𝐧𝐭 𝐒𝐜𝐞𝐧𝐚𝐫𝐢𝐨? The Supreme Court’s ruling in July 2023 limited enrolment fees: • ₹750 for general candidates. • ₹125 for SC/ST candidates. The statutory fee hasn’t been revised since 1993, despite rising costs. 𝐁𝐂𝐈’𝐬 𝐒𝐭𝐚𝐧𝐝𝐩𝐨𝐢𝐧𝐭 Enrolment fees are the main source of income for Bar Councils. Without an increase, Bar Councils face operational challenges, including: • Delayed staff salaries. • Inability to cover administrative expenses. 𝐏𝐫𝐨𝐩𝐨𝐬𝐞𝐝 𝐂𝐡𝐚𝐧𝐠𝐞𝐬 𝐛𝐲 𝐭𝐡𝐞 𝐁𝐂𝐈 - General Category Fees: ₹25,000 for State Bar Councils + ₹6,250 for the BCI fund. - SC/ST Fees: ₹10,000 for State Bar Councils + ₹2,500 for the BCI fund. Suggestion to adjust fees periodically, based on inflation rates. 𝐓𝐡𝐞 𝐀𝐫𝐠𝐮𝐦𝐞𝐧𝐭 𝐟𝐨𝐫 𝐂𝐡𝐚𝐧𝐠𝐞 • Inflation data suggests that items costing ₹100 in 1960 now cost over ₹7,800 in 2022. • BCI claims that a proportionate enrolment fee today would be approximately ₹50,000.
