There’s a very high-profile case between loan defaulter and Union bank. Loan defaulters tend to react and pay only once they know that their property would get sold in the bank’s auction. The honorable Supreme Court ruled that defaulters lose the right to redemption once auction notice is released and upheld the sale of a secured property in an auction, under the #SARFAESIAct. The Plot nos. D-105, D 110 and D-111 respectively situated at the Trans Thane Creek Industrial Area MIDC Village Shirwane, Thane, Belapur Road, Nerul, Navi Mumbai, Thane, Maharashtra measuring 16,200 square meters, was auctioned during the 9th auction on June 30, 2023, with a reserve price of ₹105 crore, and was bought by Celir LLP for ₹105.05 crore. The loan borrower tried to repay the dues and stop the 9th auction after the notice was published. They also transferred the property to another party to block recovery. The Supreme Court ruled that under the SARFAESI Act, borrowers lose the right to repay once the auction notice is published. The Court confirmed the auction's validity and criticized the borrower for misusing legal processes to delay recovery. For further details, refer to the case of Celir LLP v. Three big judgments: 1) The Borrower loses the right to redemption once the auction notice is released. That is the power and sanctity provided to the release of Auction Sale notice under the SARFAESI Act now. Buyers can buy now with more Confidence. 2) The sale cannot be cancelled, unless the buyer defaults in making the payment of sale consideration. 3) When buying under SARFAESI Act, the Authorized officer can send a request letter to the respective SRO to update the title in Book 1, which is a transfer of title and reflect in encumbrance certificate. In such cases, the sale certificate issued by the bank is registered under the Registration Act with the payment of registration charges. The stamp duty is not compulsory. Sold in eleventh auction at 50% higher value. A public sector #bank has put up a property for auction after a loan default for 11 times. They kept reducing the price, periodically to make it attractive. During 15 months, the price came down by 40%. And imagine the cost of publishing the sale notice in two newspapers, every time it was put up for auction. The total spend would have been comparable to the recovery made. Anyways, point is that we marketed it and brought multiple bidders in the #auction. We sold it for 50% higher. On the demand side, getting a commercial #property with rent yielding potential in #Gurugram for this price of 16 lakhs is nearly impossible in the open market.
