This incident is a stark reminder of the risks posed by bad actors entering the digital health space without the necessary healthcare background or a genuine regard for patient wellbeing. As someone deeply committed to disrupting and improving our broken healthcare system, I believe this situation highlights critical issues we must address to safeguard patient care.
The Incident
According to the U.S. Department of Justice, the founder and CEO, along with the clinical president of the company, were arrested for their roles in distributing large quantities of Adderall, a Schedule II controlled substance, without proper medical oversight. This misuse of digital healthcare platforms not only violates legal and ethical standards but also endangers the health and safety of countless patients.
The Risks of Unregulated Disruption
While innovation is crucial for advancing healthcare, it must be pursued responsibly. The digital health space is rapidly evolving, attracting individuals and organizations eager to capitalize on its growth. However, when those entering the market lack a solid healthcare background, the focus can shift from patient care to profit, leading to dangerous outcomes.
Personal Experiences and Insights
Serving as a board member of the Texas Pharmacy Association has provided me with firsthand insights into how these bad actors negatively impact local pharmacies. I've witnessed cases where unscrupulous entities were churning out Schedule II prescriptions with the assistance of out-of-state doctors. This practice became so rampant that the regional headquarters of large retail chains such as CVS Pharmacy , Walgreens & H-E-B had to start blocking prescriptions from these doctors to protect patient safety and maintain the integrity of their operations.
This situation created significant challenges for local pharmacies, which were caught in the crossfire of trying to maintain ethical standards while dealing with an influx of questionable prescriptions. The lack of proper oversight and the prioritization of profit over patient care by these bad actors underscored the urgent need for stricter regulations and more responsible practices in the digital health industry.
Patient-Centric Decisions at Nimbus Healthcare
When I first started Nimbus Healthcare, we experienced rapid growth in our hormone optimization for men services. However, as we began managing these patients, it quickly became apparent to both myself and our Chief Strategy Officer, Richard Harris MD, PharmD, MBA , that relying solely on at-home tests would not provide the accurate lab data needed for effective monitoring and evaluation. We realized that venous blood draws were essential for obtaining their CBC's and CMP's and other pertinent lab results for monitoring.
This posed several significant challenges in terms of finances and workflow. Nevertheless, we made the patient-centric decision to halt future enrollment until we developed a solution. We implemented an at-home blood draw feature using mobile phlebotomists and a tech-driven option for patients to get their draws at participating labs. How many non-healthcare founders would have made this call?

6moThe rapid infiltration of startup mindset and data-driven processes is a blessing and a curse to healthcare. While we may now be more keen on what drives better patient outcomes, we are also now very good at seeing what drives growth. Compound that with unrealistic valuations and uncontrollable cash burn, and you get into a world where you’re forced to shut down or do whatever it takes to keep the doors open.
