🔸 Legal design doesn't apply only to consumer-facing agreements like Terms of Use, but also to commercial contracts such as NDAs and MSAs. The end result looks different, but it absolutely can (and should) be done.
🔸 Plain language doesn't always mean replacing the legal terminology, which makes lawyers worry about enforceability. Sometimes, like we did in the Contract Nerds Terms of Use, it means adding a short summary next to the legalese to help explain it in lay terms. That way you have the legalese that you're used to plus the plain language that readers are often looking for.
🔸To advocate for legal design within your company, start small and layer on. This allows your leadership some time to process the changes and see the positive results, as well as build an understanding of what legal design means. Little things like updating font sizes or adding your company logo to your contract templates are easy ways to get started.
