Thoughts on Tenant's Rights Tuesday One of the most shameful parts of my job is explaining to someone losing their home how the eviction process works. I’m telling my client, in stark terms, that Ohio’s laws—and, more broadly, American laws—favor property rights over people. The system prioritizes buildings as investments for landowners and businesses, while tenants—who need these buildings as homes—are left with little protection. I promise I'm not on a high horse here - I’ve bought into this system in ways most people never will. I’ve spent years and thousands of dollars becoming part of it, believing it would be a tool for justice. Yet here I am, explaining how the law is rigged against people who just need a place to live. They don’t teach you this in law school. The theories of justice and fairness we discuss in classrooms feel distant and manageable, but none of it prepares you for the harsh reality of sitting across from a client in tears, holding onto what little they have left while you talk about a broken system.
Landlords in most states can illegally lockout tenants from their homes without facing a criminal penalty. Illegal lockouts can be extremely destabilizing for tenants who have few if any rights for fighting back. When tenants have the rights they deserve, their lives and their communities improve. If security deposit to be returned to Tenant is less than INR 50,000, Tenant will have to incur fees for legal notice + filing/drafting recovery suit+ Miscellaneous expenses till the date of final order is passed by court? Worst case, this landlord never turned up after receiving summons, to what extent will Tenant suffer, although exparte can be ordered in favor of Tenant? Still, there is no luck, Tenant will have to incur additional legal fees i.e. attachment of property etc. Do you think, for recovery of amount less than INR 50 K, litigation expenses are proportionate to the amount claimed? Also, consider the no of years tenant will waste in this legal battle.
