Capital versus Revenue A lump sum payment received for the grant of a patent licence for a term of years may be a capital and not a revenue receipt; whether or not it is so must depend on any particular facts which, in the particular case, may throw light upon its real character, including, of course, the terms of the agreement under which the licence is granted. If the lump sum is arrived at by reference to some anticipated quantum of user it will normally be income in the hands of the recipient. If it is not, and if there is nothing else in the case which points to an income character it must be regarded as capital. This distinction is in some respects analogous to the familiar and perhaps equally fine distinction between payments of a purchase price by instalments and payment of a purchase price by way of an annuity over a period of years. - Commissioners of Inland Revenue v. Below is the official entry description: ********************************************************** Bond Technologies CW-15 (Canister Welder, 15 Tons) Bond Technologies, Inc. has designed, manufactured and installed the world’s first welding machine for sealing canisters of nuclear fuel for safe final disposal. The machine is installed in Finland, at a geological repository for the hazardous materials. Bond’s machine is part of the world’s first permanent storage solution for nuclear waste. The process begins with taking spent nuclear fuel rods and placing them inside a fivemeter copper canister that has 50 mm (two-inch) thick walls. Bond’s machine uses Friction Stir Welding (FSW) to permanently seal a lid onto the copper canisters, which are then buried in bedrock at a depth of 420 meters (1,378 feet). The lid is sealed by the welding process so that groundwater flowing in bedrock cannot interact with the spent fuel. The cannister’s lifetime is estimated at 100,000 years. Friction Stir Welding (FSW) is a solid-state joining process that doesn’t melt the material. Instead, the friction creates a softened region near a spinning tool, mechanically mixing and forging the material into a very strong bond. FSW can be used to join metals not easily fused with traditional welding, such as aluminum, copper and other metal alloys.
