Generally, an HOA can limit the type of pet or breed allowed in the community by modifying its Rules and regulations and having these filed with the covenant documents at the county real property records. The procedure for amending or modifying HOA rules is dictated by either the initial CCRs or Rules that founded the HOA. Most of the time, the amendment will require a majority of homeowners. Service animals, as defined by Federal law or rules, that are not Emotional Support Animals, are not considered pets and therefore the restriction would generally not apply. The more successful limitations involve prohibition against generally known "dangerous breeds" that can be looked up on the Internet. Not all homeowners will agree with these restrictions, but the HOA can consider a grandfather clause that allows current animals before a certain date before the restriction takes place.
