This latest Kluwer blog post provides a really nice overview of the limitations on the ability of French public entities to arbitrate their disputes, in light of a recent decision by the Conseil d’Etat, France's highest administrative court. I'm currently supervising a PhD on this issue (not specifically on France), which has interesting variations from one jurisdiction to another.
