2024 has seen increased class and collective actions brought by New York golf club caddies under the federal Fair Labor Standards Act (FLSA) and the New York Labor Law (NYLL). The caddies claim they are misclassified employees of the golf clubs they work at and, as such, have not been properly paid wages under federal and New York state law. Caddies are typically paid directly by club members and do not receive wages from golf clubs. Thus, in general, clubs treat caddies as independent contractors rather than as employees who are afforded different protections under the FLSA and the NYLL. These recent cases may turn on a legal determination concerning whether caddies are properly classified as independent contractors or should be treated as employees. 📖 Read more in this #GTAdvisory written by Todd H. Last Friday was “National Tradesmen Day”. Celebrated annually on the 3rd Friday of September, National Tradesmen Day was created in 2011 by Irwin Industrial Tools, “to celebrate all that they do to contribute so meaningfully to our lives in so many ways”. It’s a day for appreciating and honoring the men and women who build and develop our country’s infrastructure, and it’s not an exaggeration to say that Tradespeople are the reason our county keeps running. Without these skilled professionals, our homes and commercial buildings would fall into disrepair, or never have been built in the first place. The roads on which we drive, and their maintenance which we take for granted, would cease to function. We would have no clean water, or controllable plumbing, heating, ventilation, or electricity. We would very quickly be living with the technology and accommodations which we moved away from hundreds of years ago. During the Pandemic, Tradesmen were considered “Essential Workers”, with good reason. Without their knowledge, expertise, and efforts, we would be living in a much less safe and sanitary world than we do now.
