This November, the Judiciary is observing the National Child Justice Month. The theme for this year is: "Enhancing Child Justice through Preliminary Inquiry and Diversion: Promoting Rehabilitation, Reintegration, and Dignity for Children in Conflict with the Law." As someone who represents children in conflict with the law pro bono, I’ve witnessed firsthand the gaps in our child justice system. We still face significant challenges: 🔸 Lack of child-friendly courtrooms and holding rooms; children are still tried in courts together with adults which causes unnecessary fear, stigma and trauma. 🔸Shortages of trained personnel; Handling children require patience, sensitivity, and understanding skills which most of the staff lack. 🔸 The lack of child-friendly courtrooms means that the cases are often delayed which most of the time affects their studies. The following needs to be done : 🔹 Child-Friendly Justice Systems: Increase specialized children’s courts that are welcoming and safe for children. 🔹 Training the judiciary staff, police and social workers with the skills on how to handle the children's cases sensitively. 🔹 Ensure separate, safe, and hygienic holding facilities with access to counseling. 🔹The courts should embrace the various diversion programs that are provided under the Children's Act, 2022 that will ensure that the children are kept out the courts so that they can safely continue with their studies and lives. #ChildJustice #ChildRights #Diversion #RehabilitationOverPunishment #Kenya
