This week, Laffey Bucci D’Andrea Reich & Ryan is marking one year since the Pennsylvania Supreme Court affirmed Sullivan v. Werner, a products liability case led by Jeffrey F. Laffey, Esq. and M. Stewart Ryan. The ruling upheld the exclusion of industry and government standards at trial, setting a critical precedent: manufacturers cannot shield themselves with industry-influenced standards. Recent rulings in Hillman v. Toro and White v. GM highlight the critical need for scientifically reliable expert testimony to establish proximate cause in product liability cases. Courts are excluding opinions that lack specific testing or robust methodologies, stressing the importance of clear evidence linking design defects to injuries. When the US Supreme Court issued it’s opinion in Mallory, it highlighted a concept known as “consent jurisdiction,” where a corporation consents to jurisdiction by doing business in a state. This concept scares corporate clients because it makes it more likely that they will be subject to suit in jurisdictions that tend to award larger verdicts against corporate torfeasors. The Mallory decision upheld a Pennsylvania consent jurisdiction statute. Guess which state has a similar statute and law? The answer is Georgia. The statute, codified at O.C.G.A. § 9-10-91, confers specific personal jurisdiction over an out-of-state defendant if, among other things, he “[t]ransacts any business within [Georgia][.]” O.C.G.A. § 9-10-91(1); see also Cooper Tire & Rubber Co. v. McCall, 312 Ga. 422, 429 (2021).

Air Supply, Esq.: "Paying claims out of nothing at all" "Clearview and the Class members were trapped together on a sinking ship: the potential liability was massive, there was no money for a substantial settlement, and the costs of litigation itself would bankrupt Clearview before the case ever got to trial, leaving nothing for the Class members." So what did they do? They gave the claimants 23% of the company. Interestingly, Defendant is a private company and most class members are not likely Accredited Investors so they could not issue shares to class members. Instead the ownership stake is to be put into a Settlement Fund that can be liquidated later. While it sounds novel, these types of payment via economic stake are not unheard of in the tort context and we saw something similar in the Purdue Pharma settlement, where the defendant would - upon emerging from bankruptcy - convert into a public benefit company owned by a trust or similar entity designed for the benefit of the American public and the proceeds of the trust will be directed toward State and local opioid abatement programs. This is certainly an unorthodox way to increase one's investor base....
