It is interesting to see things change in leasing and tenant risk. Since restaurants had such a high failure rate they were less popular to landlords but since the pandemic small local restaurants just keep showing up. In our area it is very rare for a restaurant to close for lack of business, but it has still always been risky. https://lnkd.in/eNpziKQD Someone who loves Nantucket recently sent me this sad piece about an island favorite that is closing due to a “shocking” dispute over the renewal of their lease. Of course, they do not disclose what the dispute was, but what strikes me is, how there could ever be a shocking dispute when it comes to a lease renewal? After all, the whole purpose of a restaurant lease is to avoid surprises and unnecessary reliance on the goodwill of your landlord. Typically, when things are going well, no one ever looks at the lease after it is signed until it is time for renewal. If done right, the renewal provision should offer a straight-forward road map that guides the parties through the renewal process – leaving nothing to chance, or whim. We’d all like to think that business can be done by a handshake, but in the real world there is nothing that can substitute for a carefully negotiated lease. It is difficult enough to run business in a seasonal market like Nantucket, and it’s a shame that the community is losing another gem due to a dispute that might have been avoided. The accommodation and food-services sector is the second-hardest-hit industry after construction in Australia, according to government data. The liquidations are being driven largely by small to medium operators with lower cash reserves. The pressures are not restricted to Australia, nor exclusive to high-end restaurants. The US fast-casual chain Red Lobster filed for Chapter 11 bankruptcy in May, citing a failed unlimited shrimp deal, along with inflationary pressures and higher labor costs, among the reasons. But some restaurateurs are taking advantage of the current climate by picking up distressed properties at a discount. The operator hopes he can ride the current downturn for an additional 12 to 18 months, working long hours and trying to keep costs down to remain profitable. “In the worst-case scenario, we will just have to start trimming the fat,” Stavrou says. #foodservice #foodandbeverage #businessstrategy

STRATA OWNERS & MANAGERS, do you believe this is an acceptable motion? Every year, like clockwork, our committee trots out that motion at the AGM, you know, the one where our Strata Manager, concierge, and building managers are invited to a luxury dinner, all generously funded by the owners. And every year, I’m the one to rain on their parade by pointing out that this little extravagance is breaching the Strata Schemes Management Act. Last year, Fair Trading finally stepped in with a polite slap on the wrist for our Strata Manager. Mind you, this wasn’t their first rodeo, they’d already been issued a Trade Warning years earlier for a completely different breach. But apparently, warnings aren’t like desserts, Fair Trading doesn’t believe in serving seconds. It’s worth mentioning that many AGMs can’t even muster a quorum. But don’t worry, there’s a handy workaround: wait 30 minutes, and like magic, the meeting proceeds anyway. Now, if only rallying owners to engage were as easy as rallying committee members to justify a fancy dinner! And here’s a question for all the strata owners out there: does your scheme throw a lavish dinner for the committee each year? If not, maybe that’s because they’re focused on governance instead of gastronomy. If you’ve ever wondered why strata managers and service providers seem to side with committees, look no further. The answer is often plated up for them, sometimes with garnish. This is just one more reason I continue to call for a Formal Inquiry into the management of Strata Schemes.
