Minnesota has passed a new pay transparency law that will require employers with 30 or more employees to provide salary ranges on job postings beginning Jan. 1, 2025. Minnesota now joins several other U.S. states that require salary ranges on job postings. California, Colorado, Hawaii, Illinois, New York, and Washington state all have salary range requirements on job postings. Maryland’s updated pay transparency law will take effect Oct. 1, 2024. Does the Labour Government know what it’s doing? The long-awaited budget revealed a 40 billion tax bill for the nation with more than half of it falling on employers in the form of increased employer National Insurance contributions. On the face of it, this does not seem a clear pathway to economic growth which is this government's primary goal. This followed quick on the heels of a whole new raft of workplace regulations that employers will have to embrace, some now and some in two years’ time. By any measure, this is a lot for the nation's employers to take on. Most of the immediate commentary on these new workplace regulations and the new National Insurance regime has frankly been all too predictable. As usual, the media goes for the easiest scare story to tell and business leaders from James Dyson to Charlie Mullins of Pimlico Plumbers queue up to add their view. Even the venerable CIPD have published a warning by “HR experts” that this could significantly impact hiring and skills investment. What evidence this is based on, they don’t say. Certainly not the introduction of the minimum wage where predictions of doom and gloom caused by paying people a living wage proved as wrong as the millennium bug. So, is all this all a great disincentive to employ people? The Government may be thinking that employers do not have a choice when the competition for employable talent is fierce. If you don't offer these new workplace terms and conditions or are unwilling to pay the new rates of NI and perhaps employ fewer people you are going to put yourself at a serious competitive disadvantage. What has happened here is that the government, unwittingly or not, has made the competition for good staff even more intense. Business is and always has been a very competitive activity. It is a near zero sum game where somebody wins, and somebody loses. Businesses compete for finance, customers, suppliers and most of all talent. It’s well documented that millennials and Gen z provide new challenges in the workplace environment. Well, that situation just got worse. Progressive employers in competitive companies won’t be queuing up to beef about this. They will be going out and getting themselves match fit for perhaps the stiffest competition we’ve ever seen for talent. They will be all over these new regulations and have new talent management strategies to cope with a developing situation.
