Rick, maybe consider how the NIL “thing” has evolved. Ruling was that players retain their rights to their name, image and likeness. Implication was that they were not controlled by NCAA or school in exploiting those rights. NOW, can there be any question that Duke totally controlled the “allocation” of Duke’s NIL war chest to the player. Said another way, Duke recruited this player and “raised” the money to pay him. I am not saying that this is either wrong or bad (although the fiction of it seems silly). Players fought and won these rights. But now the schools have taken control of them. Seems to me harder and harder for the schools/ NCAA to argue they are not employers.
