I posted about this a few weeks ago upon hearing it at a session at the IRMI Construction Conference, but reiterating it since I saw such contract wording today in a draft property management agreement. Limitation of liability wording that ties to insurance coverage could be problematic. The wording I saw today lets a party off the hook if their insurance does not cover a particular matter. Attributing or assigning liability to another party is best not to be contingent upon whether their insurance coverage applies. In the current market with numerous limitations in coverage and many novel exclusions finding their way into policies, coverage may never have been so tenuous, and to tie a party's liability to their insurance coverage could be a risk not worth taking.
