State Route 37 - Draft Supplemental Environmental Document Released Caltrans has released a Draft Supplemental Environmental Impact Report (Draft SEIR) for the SR 37 Sears Point to Mare Island Improvement Project. This Draft SEIR provides information to address proposed changes since the Final Environmental Document for this Project was approved in 2023. These changes include additional highway improvements and the enhancement of degraded marsh habitat at Strip Marsh East to minimize Project impacts on wetlands, waters, and special-status species habitat. The public review period for this Draft SEIR is from December 18, 2024 to February 3, 2025. This ruling will certainly be worth keeping an eye on as it could have significant implications for NEPA review of renewable energy projects. The conventional "sides" of liberal versus conservative, environment versus industry, environmental protection versus economic growth are muddled when it comes to energy infrastructure. For those of us who got into the energy industry to advance renewables, reduce emissions, and incent meaningful change, we have also been witness to agency overreach where energy projects key to meeting climate goals are blocked or delayed by agencies acting outside of their regulatory authority. So this case, along with the recent Chevron Deference ruling may, on their face, be perceived as a threat to the environment, but it's not that simple. Hopefully we will all learn in this process and move forward with whatever rulings are announced to create the future we seek - regardless of the level of agency review or determination of "hard look". Columbia River environmental review begins, agencies seek input USACE and Reclamation are seeking public input on changed circumstances and new information regarding Columbia River System operations to inform preparation of a Supplemental Environmental Impact Statement (SEIS). In 2008, the US Environmental Protection Agency (EPA) enacted the RE-Powering America’s Land Initiative to encourage #renewable energy development on current and formerly contaminated lands, landfills, and mine sites, including brownfields. This initiative not only investigates the potential of these sites and helps developers access resources, but also offers a mapping tool to help identify eligible #brownfield sites. The Delta Tribal Environmental Coalition (DTEC), San Francisco Baykeeper, California Indian Environmental Alliance (CIEA), and Golden State Salmon Association on July 14, 2024 filed a joint objection letter in response to the State Water Resources Control Board's June 19, 2024 Notice of Assignment and Pre-Hearing Conference on the Department of Water Resources’ Petition for Change of Water Rights Permits associated with the Delta Conveyance Project (also known as the Delta tunnel). Restore the Delta, alongside this broad coalition, is urging the Presiding Hearing Officer to postpone the pre-hearing conference due to the scheduling overlap with the Sites Reservoir proceedings, ongoing Civil Rights Complaint with DTEC, and the pending update to the Bay-Delta Plan. This is yet another example of water management not proceeding in the proper order of operation necessary to properly manage California's fragile ecosystem.
