The Strikes (Minimum Service Levels) Act will be repealed when the government passes the forthcoming Employment Rights Bill, expected in Autumn 2024. The Act, which imposed mandatory minimum service levels, sparked significant controversy by restricting the right to strike and granting employers the legal power to issue 'work notices,' forcing employees to work on strike days. Since it was introduced, trade unions such as UNISON and TUC have been against the act including conducting a protest in January 2024. And due to their hard work, no work notices have actually been issued since the act was passed in 2023. UNISON general secretary, Christina McAnea, stated that the legislation was “terrible” and that no organisation had used the law as by doing so, there was a risk of creating further tension in the workplace. The Labour Party have always been against the legislation, and now they are in government, they have indicated that whilst the act will remain in place for the next few months, employers should look at alternatives such as voluntary workers rather than minimum service levels. #EmploymentLaw #EmploymentLawSolicitors #Solicitors #LegalAdvice #SmallBusiness

The King revealed in his speech last week that there will be new employment laws and practices put into place to ban ‘exploitative’ work. It’s looking likely this will include: - Day one rights for unfair dismissal, subject to special rules surrounding probationary periods. How this will work and whether employers can simply put in place a two-year probationary period is presently unclear; - Improvements to statutory sick pay and the minimum wage; and - The repeal of the recently introduced Strikes (Minimum Service Levels) Act, allows some employers to compel employees to work during a strike. Additionally, there is set to be greater equal pay protections and a requirement for businesses that have over 250 employees to publish ethnicity and disability pay gap reports - a measure that was rejected by the previous government. In the next few years, it will be interesting to see which pre-election pledges come to fruition, and how they they will affect employment law as we currently know it. #EmploymentLaw #EmploymentLawSolicitors #Solicitors #LegalAdvice #SmallBusiness
