Sustaining the Commons - rules, norms and shared strategies are the text of an institutional arrangement. But we have to understand the differences between them. Consequences of rules are important. Breaking the speed limit vs not performing the duty of voting. There maybe no consequences for not voting in many countries. Many ‘must’ and ‘must not’ are not rules - taking a photo in a museum maybe against a ‘’must not” but may have no consequences. Rules maybe shared strategies or norms. For ex., Must show ID to buy alcohol vs Please recycle. These need analysis in the institutional context. Dress codes, and such institutional statements or grammar tools that allow the analysis of rules, norms and shared strategies. If you use the microwave, you must clean up your own mess! Sustaining the Commons - after classifying the rules, we now look at the types of rules. Seven broader types emerge - position, boundary, choice, aggregation, information, payoff and scope. They create positions, determine how actors are assigned or leave positions, assignment of actions to positions, links between actions and outcomes and so on. The verbs associated with the rule are: be, enter or leave, do, jointly affect, send or receive, pay or receive and occur. Control, costs/benefits and outcomes are the components of action situations. The Netherlands example of taxi medallions is a good case study: a lack of local boundaries on where they can operate led to serious and violent conflicts. Boundary rule changes led to higher prices and lower quality of service! The Scottish Government will review a new law that effectively bans wood-burning stoves in new build homes. It came into effect on 1 April 2024 and was designed to help reduce air pollution and ensure that heat pumps and heat networks were preferred. The new rules have no impact on properties that already have the appliances but do apply to those looking to change the use of an existing property. Some exemptions include using the burner as an emergency heating system or for frost protection. Minister for Climate Action Gillian Martin said she would adapt the New Build Heat Standard regulations to suit the differing needs of urban and rural areas after rural groups called for a change. Details are yet to emerge on what changes will be made to address what Ms Martin called issues of inflexibility.

Landmark judgment by the ECtHR on climate change! Failure by a State to provide, and effectively apply in practice, effective protection of individuals from the adverse effects of climate change through a satisfactory regulatory framework violates the right to private and family life, which is enshrined in art. 8 ot the Convention! It will be indeed very interesting to see how the CJEU and national courts will react, as well as the possible developments in their jurisprudence. The judgment can be found here:

In today’s polarized climate, some argue that the Constitution is outdated or insufficient for modern challenges. This notion is not only wrong but dangerous. The Constitution doesn’t need rewriting or reinterpreting—it needs to be reread, respected, and followed. The Founders created the Constitution to protect individual liberty, limit government power, and safeguard against tyranny. These principles are as relevant today as ever. The problem isn’t the document itself; it’s our leaders’ failure to adhere to it. From bureaucratic overreach to judicial activism, ignoring the Constitution has eroded our freedoms. The Constitution isn’t a barrier to progress—it’s the foundation of it. It protects our God-given rights and provides a framework for addressing modern challenges without sacrificing liberty. True progress comes from honoring these enduring truths, not abandoning them for fleeting trends. Let us recommit to defending the Constitution—not as a relic of the past, but as the cornerstone of our future. It doesn’t need rewriting; it needs protecting. It doesn’t need reinterpreting; it needs respecting.

ECtHR rules that climate change claims are admissible in limited circumstances and that a State's failure to take effective action to combat climate change can amount to an infringement of Article 8 right to private life.
