It was obviously wrong not to correct the PI carveout. That is the finding of the UPC Court of Appeal in the judgement of 11 december 2024 in Magna v Valeo, which led to a suspension of the provisional injunction to also cover supplies for the BMW 2 Series Gran Coupé car model, in addition to the models already on the exemption list: https://lnkd.in/eAvynRqX It started with a PI of the Düsseldorf Local Division of 31 October 2024 which contained a carveout for supplies for certain BMW models because of a balancing of interests. That was. Claiming the BMW2 series should have been on the list Magna applied for suspensive effect of the order, which was granted by the standing judge of the Court of Appeal at 14 November 2024, awaiting clarification by the first instance court. The Düsseldorf Local Division held in its order of 20 November 2024 that there was no ground to rectify the carveout of its previous injunction because there was no error or obvious slip in its earlier ruling. Suspensive effect to that order was given one day later by another standing judge of the Court of Appeal. Subsequently the Second panel ruled in its order of 11 December 2024 that suspensive effect to the PI was given so that the list of supplies for BMW models was properly corrected The Court of Appeal held that the Court at First Instance could and should have deducted from the documents – and if uncertain in the alternative should have asked Magna at the hearing which models should be included if such a list with exempted car models was going to be drawn up, and would thus have learned – that also the 2-series Grand Coupé should be on the list. It also held that it was obviously wrong not to correct the impugned order by adding the 2-series Grand Coupé to the list of exempted cars. Bottom line seems to be that the possibility to rectify an order is not restricted to correcting clear errors of the court but may be applied generously. I'm lucky to get to speak to 100s of companies every week that have a vehicle operator licence. This gives me valuable insight to how the general VOL community feels. Unfortunately, I'm hearing more and more feedback from operators that they are considering not renewing their O Licences due to the rising costs of operating their transport businesses. This is worrying feedback to hear in an industry that is already suffering from less drivers and higher costs. Is it time to review the costs of having an Operator Licence?
