Determining whether someone is an Employee or a Contractor can be tricky! 🤔 That's where the multi-factorial test comes in. It's a test that the Fair Work Commission or the Courts will use to determine if someone is an Employee or a Contractor. This involves considering factors like: 🧩 How much control does the business have over the worker? 🧩 Who provides tools and equipment? 🧩 Are uniforms required? 🧩 Can the worker delegate work? 🧩 How is the worker paid - hourly, salary, or project-based? 🧩 Is the worker entitled to leave? 🧩 What does the contract say?
