Yet another decision finding intent to deprive under Rule 37(e) for intentional destruction of text messages, demonstrating again the need to identify and keep relevant data from mobile devices. This is the second decision from an appellate court (see the 11th Circuit decision in Skanska v. Bagelheads in comments below) awarding sanctions for failure to preserve text messages. Here, the forensic examination revealed intentional destruction that was sufficient for dismissal. Compare and contrast that to Freeman v. Guiliani (link in comments) in which the Court dismissed the case for a pattern of behavior that showed bad faith, and that bad faith is equivalent to intent, and to other decisions awarding adverse inference instructions for bad faith as well. We will cover the Jones case on Case of the Week with Association of Certified E-Discovery Specialists (ACEDS) next week, so be sure to tune in! Summary of Jones: A former waitress intentionally deleted relevant text messages and coordinated with her witnesses to do the same, with the intent to deprive her former employer of their use in a Title VII lawsuit. The district court dismissed the case with prejudice after finding that the destruction of the messages had prejudiced the employer's ability to go to trial. The court affirmed the decision, emphasizing the importance of preserving Electronically Stored Information in litigation. #ediscovery #caselaw #sanctions #mobiledevices #dismissal

As many of you may know, the Texas Business Courts started operating earlier this year. This new forum is being monitored by the legal community due to its potential to impact a wide variety of complex cases. Today, my colleague Marcus Eason and I appeared in the Fourth Division Business Court in San Antonio for what we were told was its first scheduling conference. It is exciting to be on the cutting edge in this new Court.
