EU trade mark registrations are no longer effective in #Jersey In a declaration in March 2024, as a part of the consultation on primary trade mark legislation, the Government of Jersey has announced that EU Trade Marks (EUTMs) will no longer provide protection for trade marks in Jersey. The announcement goes further in stating that existing EUTM registered marks have in fact not been subject to protection since 12 April 2009. As such, the owners of EUTMs may need to seek alternative protection if this is a key territory. Catch the replay here: https://lnkd.in/gwMBm3YP Here are the four key takeaways from the session: 1️⃣ Shift in Regulatory Focus The regulatory landscape under DDO has shifted from initial attention on TMDs and product governance to the reasonable steps obligations, particularly oversight of distributors. ASIC has emphasised shortcomings in distributor monitoring practices, urging issuers to perform meaningful due diligence and avoid over-reliance on self-certifications or minimal checks like confirming AFSL licenses. 2️⃣ Meaningful Compliance Expected ASIC’s recent report 795 raises the bar for compliance, recommending structured due diligence processes, meaningful assessment of distributors’ capacity, and detailed analysis of their practices. The report highlighted the need for consistent, comparable, and detailed data gathering and follow-up on distributor responses to ensure robust oversight. 3️⃣ Collaboration Across the Ecosystem Effective compliance under DDO requires cooperation among all stakeholders, including Regulators, Issuers, Distributors, and auditors. Product Issuers are currently shouldering much of the compliance burden, but there is a need for greater scrutiny and accountability for Distributors to ensure the regime functions cohesively and consumers are protected. 4️⃣ Technology is Key Sustainable compliance requires leveraging technology and partnerships. The KYD solution is a efficient way for Issuers and Distributors to streamline Distributor due diligence, reducing reliance on manual processes and meeting the heightened regulatory expectations.
