New to the Forum: Terry Carney, Shih-Ning Then and Craig Sinclair, 'A New Aged Care Act: Progress in Implementing a Supported Decision-Making Approach in Australia's Federation?' This article evaluates the first legislative attempt by the Commonwealth to honour its commitments under the United Nations Convention on the Rights of Persons with Disabilities (‘CRPD’), by introducing a supported decision-making framework into the federally funded aged care system. The article concludes that the consultative process to develop a new Aged Care Act incorporating such a framework has so far been both fruitful but also very deficient. It is suggested that the design of the two new appointments (supporters and representatives) cleaves closely to CRPD requirements. However, it is argued that the reliance on administrative processes for making and monitoring Commonwealth appointments and the relationship with state and territory equivalent powers and appointments is less than ideal. The proposed Act raises questions regarding how the new system will practically interface with existing state and territory regimes, how best to recognise the principle of subsidiarity in this context and presents a timely reminder of the limits of what the Commonwealth can and should seek to achieve within the Australian federation. Healthcare leaders, legal teams and digital agencies - take a second this morning to read my urgent note below! The deadline for HHS Digital Accessibility compliance is only about a year and a half away. Not to sound the alarm, but I'm concerned with how few large healthcare providers are either not aware of these regulations (I'm still hearing this weekly) for their digital footprint OR thinking about this as a 2026 initiative. The deadline for compliance of websites, mobile applications, digital documents and so on is May of 2026. For the many healthcare providers our team here at Allyant is supporting on this topic, their procurement cycle is 6+ months for onboarding a new vendor and the path to getting large digital footprints into compliance is 12-18 months. With that as a loose timeline, your team WILL be scrambling to move your digital properties into the required WCAG conformance level in time to meet these HHS regulations if you have not already started onboarding a vendor. Chloe Gibbs highlighted the need to consider all elements of the care infrastructure, including not just care facilities but also policies like work flexibility and parental leave. Lidia Farré presented compelling findings on how parental leave can have intergenerational effects on social norms. Emilia Brito discussed the caregiver penalty for women, noting that these intergenerational effects could be factored into cost-benefit analyses of health interventions.
