Civil Engineers & VCAT If you’re a civil engineer looking for work in Australia with local council, government authority or with any company involved in land development, it’s vital to understand the planning issues confronting specific municipalities and shires. An awareness of such issues will demonstrate a local knowledge and attention to the needs of the employer – you’ve actually done some research on the challenges they are facing. Your cover letter/email/phone conversation will be a breath of fresh air amongst a pile a CVs just listing candidates’ experience. Each state has its own Civil & Administrative Tribunal which resolves disputes and makes decisions in relation to development. For example, they hear matters regarding Environment and Resources, falling under the following environment and resource management enactments: Catchment and Land Protection Act 1994 Circular Economy (Waste Reduction and Recycling) Act 2021 Climate Change Act 2017 Conservation, Forests and Lands Act 1987 Environment Protection Act 2017 Flora and Fauna Guarantee Act 1988 Melbourne Strategic Assessment (Environment Mitigation Levy) Act 2020 Mineral Resources (Sustainable Development) Act 1990 Petroleum Act 1998 Plant Biosecurity Act 2010 Radiation Act 2005 Water Act 1989 The great thing is that tribunal hearings are open to the public. That’s right, you can listen to both sides arguing their case in relation to proposed developments. You will come away from the hearing with greater insight into issues relating to water, land & environmental management; design assessment of projects; and impact of development on traders and residents. I have sympathy for the Environmental Agency who operate between a rock and a hard place in both protecting the environment and enforcing statutory regulations, whilst within the context of being under resourced. However, they also seemingly lack understanding and trust in the Civil Engineering Industry who from my viewpoint, overall operate to protect the environment. This is not helped by the excessively long period of time it takes for the EA to process and issue abstraction and discharge licences for temporary groundwater control projects, which reasonable construction programmes cannot allow for, or can adapt quickly to changes in design as works progress. Unfortunately, the excessive permitting process is resulting in legal proceedings as in this case or clients having no alternative than to delay or cancel projects that ultimately improve the environment. Or Civil Engineering contractors using less environmentally friendly construction methods by installing more steel and concrete in the ground, which has a risk of permanently changing aquifers conditions. Unfortunately, you cannot see any improvement of this paradox in the near future. Recharging abstracted groundwater back to an aquifer as part of a #dewatering or groundwater control system on construction projects is in some cases a real option to protect an aquifer from depletion. But there is no incentive to do so it terms of the time to gain a licence. So we seemingly go around in circles of delay and overspend.
